THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.
Written acceptance of the booking conditions is a requirement.
The reservation is not confirmed until we have received a signed booking conditions agreement.
I will be responsible for my party and abide by the booking conditions. I have been advised to take out travel and cancellation insurance. I give permission for $250 to be held as a damage deposit and understand there will be no charge as long as there is no damage to the cabin and it is left in a clean and tidy condition.
To avoid misunderstandings with our guests we would remind you that a reservation constitutes a legal contract. In the event of a cancellation, both parties should endeavor to re-rent the accommodation. For a cancellation more than 45 days before the scheduled arrival date, the deposit is fully refundable less 1 night's rental plus tax. If the cancellation is within 45 days but more than 30 days, then 50% of the deposit is refundable or 2 nights rental plus tax, whichever is greater. For a cancellation with less than 30 days notice, the rental is not refundable.
Holiday Cancellations - A 60-day notice is required for cancellation of reservations within the holidays of December 18 through January 3. For a cancellation with at least 60-days notice, the cancellation fee is 2 night's rental plus tax. If less than 60 days notice is given, the reservation is not refundable.
Early check out is a cancellation and no refunds will be given. Guests are strongly advised to take out cancellation insurance coverage. Changes to your reservation are subject to a $75 processing fee. We regret that we are unable to change your reservation within 45 days of the arrival date.
Asheville Vacation Cabins is not responsible for the weather or other natural disasters and there will be no refunds for these occurrences. Purchasing trip insurance covers you from losses you may incur due to unforeseen circumstances, such as unexpected health issues, death, jury duty, and severe inclement weather. We recommend that you purchase this insurance. From November 1 to March 31, trip insurance is mandatory due to the possibility that inclement weather may inhibit access to our cabins. 50% deposit is required at the time of reservation. The balance is due 15 days before arrival. For reservations made within 15 days of the arrival date, the payment must be made in full at the time of reservation. The named person is responsible for the full payment of the cabin rental, even when members of the party are sharing the cost. Asheville Vacation Cabin's rates are for the whole cabin. Partial refunds will not be given. Special provisions may be made for early reservations.
Rent is deemed earned on the first day of the reservation. Renters agree that the deposit and rents will be placed in an interest bearing trust account. Any interest shall accrue for the benefit of, and shall be paid to, Asheville Vacation Cabins as it accrues. The trust account is in the name of Asheville Vacation Cabins Inc. at the federally insured Bank of Asheville, located at Charlotte Hwy. Asheville, NC 28803.
Check is between 3pm and 6pm. Renters are expected to have the driving directions to the cabin with them upon arrival. It is the renter's responsibility to ensure that all members of the party have the directions to the cabin. Asheville Vacation cabins Inc takes no responsibility for renters who forget their directions or who forget the check in arrangements.
All of our cabins are strictly non-smoking. Any person found to have smoked in the cabin shall forfeit the $250 security deposit and have the rental terminated with no refunds being given.
Sorry, we are unable to accept pets. Any person found to have brought a pet into the cabin shall forfeit the $250 security deposit and have the rental terminated with no refunds being given.
CARE OF OUR CABINS
All our cabins are in beautiful condition. Please leave it clean and tidy. Please report breakages prior to departure.
There will be a $25 charge per towel for any missing towel at the end of the stay (The cleaning company monitors this). There will also be a $25 charge per towel for any towels that are so badly soiled that they cannot be washed clean.
A Grill is provided. If grilling, guests are required to grill at least 15ft away from the house. Grills must be thoroughly cleaned after use. Hot or warm ashes must not be placed in the trash .
Normal usage of all utilities is included in the rent. Excessive usage may incur an extra fee. Guests are expected to switch off the heat/cooling systems when going out and when checking out. Please help us save the planet! Complimentary high speed Wi-Fi Internet access is included at all cabins.
There is a $250 deposit that we will hold against your credit card. By agreeing to the booking conditions you are agreeing to this deposit. There will be no charge, provided the cabin is left in a clean and tidy condition, that there are no missing or extremely badly soiled linens, that there was not an excessive use of the utilities and that there was no damage.
GUEST INFORMATION BOOKS
Each cabin has a guest information book for your convenience. There is a lot of valuable information in each book and we encourage each guest to review its contents upon arrival and expect guests to the follow the guidelines set forth.

Renter agrees to indemnify and hold harmless Asheville Vacation Cabins from and against any liability for personal injury or property damage sustained by any person (including guests of renter) as a result of any cause, unless caused by the negligent or willful act of Asheville Vacation Cabins or their failure to comply with the Vacation Rental Act. The use of illegal substances and illegal activities is strictly prohibited at our cabins. It is the policy of Asheville Vacation Cabins to report such incidents to the police. Guests are reminded to make sure they take all their personal property with them upon check out. Asheville Vacation Cabins Inc takes no responsibility for left items. At the guest's request, found items can be shipped by normal surface mail. There will be a minimum $25 handling fee plus the cost of postage and packaging.
NON DISPARAGEMENT CLAUSE
We strive to keep our cabins in perfect condition and do upgrade accommodations on a regular basis. If there is anything that is a concern please notify us immediately. Our goal is for our guests to have a very enjoyable vacation and to return to stay with us again, as many guests do. In recent times there have been websites asking guests for “reviews” without our permission. These websites include VRBO. It is a condition of booking with us that our guests do not submit reviews or comments about our properties on any public website without our express and written permission. By doing so such a guest would be liable for breach of this contract and also may be liable for any loss of business resulting from a negative comment.
NOISE AND NUISANCE
Asheville Vacation Cabins Inc has a strict No Partying rule.. Minimum rental age is 25. Guests are not permitted to invite ‘visitors” over and beyond the reserved party unless given consent in writing by Asheville Vacation Cabins. Any guests who causes a nuisance or unreasonable amount of noise or otherwise disturbs neighbors may have their rental terminated with no refund. Illegal activities are strictly prohibited and Asheville vacation Cabins will report such incidents to the police. It is NOT permitted to use the hot tub before 7am or after 10pm .
TRESPASSING ON NEIGHBORS PROPERTY RE SASHAS CABIN
Fairview Forest is a private residential community. Please respect neighbors rights to privacy.
It is a condition of booking Sasha's cabin that guests do not either intentionally or unintentionally trespass on neighbors' properties.
The southern boundary of the property of Sasha's is clearly marked with a sign and tree tag. Please also review the survey in the guest information book. All the seven acres is to the west of the road and is in front of the house.
Trespass is illegal and such occurrence may be reported to law enforcement.
If a guest trespasses on a neighbors' property they may have their rental terminated immediately with no refund.
MAINTENANCE & CABIN USE
Asheville Vacation Cabins, in accordance with the NC Vacation Rental Act Article 5, seeks to provide you with a rental cabin that is well maintained and in good working order. We do however expect tenants to perform basic functions (i.e. changing light bulbs, plunging a toilet, following written instructions for TV, hot tub and woodstove operation and the like). If we are called out for a maintenance request in which the renter could easily remedy the situation and/or if the tenant is at fault, there will be a call out fee of $25 per hour. If the required repair is no fault of the renter and cannot easily be remedied by the renter, then there will be not cost to the renter. If the renter is in doubt regarding a maintenance issue, he or she should call first before attempting any repairs. Guests are prohibited from tampering with smoke & fire alarms, electrical, heating and cooling systems.
Minor disruption of any utilities including, but not limited to, power outages, water outages, etc. are beyond our control and no refund or rent reduction will be given. Please report inoperative equipment to us and we will make every effort to have repairs done as quickly as possible during reasonable hours.
HOT TUB USE: RELEASE & WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
Guests use the hot tub entirely at their own risk. The renter or any person of the renter's party should not use the tub for more than 15 minutes at a time. Children under the age of 6 years are not permitted to use the tub. Guests are not permitted to use the hot tub after 10pm or before 7am, so as not to cause a nuisance to neighbors. Guests doing so may have their rental terminated and lose the $250 deposit.
Use of the hot tub carries risks that may result in serious injury or death and unsupervised use by children and minors is prohibited. Elderly persons, pregnant ladies, infants and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy, allergies or similar conditions should not enter a hot tub without first consulting a physician.
It is prohibited to use the hot tub while under the influence of alcohol or medication. If you are taking medication of any kind or being treated for any illness, consult your physician prior to using the hot tub. For your safety, the hot tub should be kept at a temperature never to be above 104 degrees. An adult must supervise children under age 15 at all times.
The undersigned hereby assumes full responsibility for risk of bodily injury, allergic reactions, infections or any other illnesses or ailments and death or property damage due to the use of the hot tub. The responsibility is assumed in respect of himself/herself and all guests, children and family whom are permitted to use the tub by the tenant.
The undersigned further expressly agrees that the foregoing release waiver and indemnity agreement is intended to be as broad and inclusive as permitted by law and that if any provision is held invalid it is agreed that the balance shall not withstanding continue in full legal force and effect.
Any dispute, controversy or claim arising out of or related to this agreement or the interpretation of this agreement shall be settled by arbitration in accordance with the rules of the American Arbitration Association.
THE UNDERSIGNED HAS READ, UNDERSTANDS THE RISKS AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABAILITY AND INDEMNITY AGREEMENT and further agrees that no oral representation, statements or inducements apart from the foregoing written agreement have been made.
Specific to Sasha's cabin
Sasha's Cabin is in a private community. It is a condition of reserving Sasha's cabin that the community rules & regulations are adhered to.The rules are designed to ensure residents & guests alike are able to enjoy the peace and tranquility of this beautiful mountain. Trespassing on neighboring private property is strictly prohibited.
Outdoor burning is prohibited due to the risk of forest fires.
Rules of Fairview Forest ( Rental Standards)
1.Outdoor fires, including bonfires, campfires, fire circles and chimineas are prohibited. 2. Fireworks of any kind are prohibited. 3.Discharging of firearms is prohibited 4. Guests shall not display signs, balloons, etc. at the house or anywhere in the community. 5. Guests shall not park on any portion of a road. Parking should be on the driveway of the house. (There is plenty of room for parking at Sashas cabin) 6. Guests shall use the cul-de-sacs at the end of the side roads to turn around.
